Today, June 21, summer officially begins, but hundreds of Ryanair workers in Spain are still not entitled to the 22 working days of annual leave or the 14 national holidays. This is denounced by USO and Sitcpla, who have called a series of six days of strike action by their cabin crew members (TCP).
The stoppages will take place on Friday, June 24, Saturday, June 25 and Sunday, June 26. Then, after a three-day break, they will continue on Thursday, July 30, Friday, July 1 and Saturday, July 2. "Ryanair crew members continue to be third-rate workers, our rights are still not respected. Ryanair has forced this strike and we have to return to the mobilization so that the reality of our situation is known, so that Ryanair is forced to comply with the application of basic labor rights and court rulings and to get to close an agreement and decent working conditions for all staff, "denounced the general secretary of the union section of USO in Ryanair, Lidia Arasanz.
The first collective agreement for Ryanair cabin crew members in Spain had been under negotiation for eight months with USO and Sitcpla. Ryanair is the only international airline in Spain without a collective agreement, according to Arasanz.
Manuel Lodeiro, from Sitcpla, has reproached that the company left the table after the announcement of possible mobilizations against its non-compliances in labor matters and after it signed an agreement with Comisiones Obreras, a union -he has denounced- without implantation among the flight personnel and to which only its affiliates can join.
Ryanair has a total workforce of 4,000 people in Spain, of which between 1,200 and 1,300 are cabin crew and the rest are pilots and ground workers, distributed in 10 bases: Madrid, Malaga, Barcelona, Alicante, Seville, Palma de Mallorca, Valencia, Girona, Santiago de Compostela and Ibiza.
What do I do if my flight is affected?
Facua-Consumers in Action assures that passengers are entitled to compensation of at least 250 euros and a refund of the ticket and any expenses they may face if their flight is cancelled.
The association cites European Regulation 261/2004, which provides for compensation of 250 euros for flights of up to 1,500 kilometers; 400 euros for intra-Community flights of more than 1,500 kilometers and other flights of between 1,500 and 3,500 kilometers; and 600 euros for all other flights.
In addition, and although the regulation provides that companies do not have to compensate if the cancellation is due to "extraordinary circumstances", Facua points out that the Court of Justice of the European Union determined in 2018 that a workers' strike does not fall into that category, so the company cannot hide behind it to avoid paying compensation.
It also cites another 2017 European ruling that recognizes that the right to compensation also applies when the flight suffers a delay of more than three hours with respect to its arrival at destination, even if it is not cancelled.
Cases in which Ryanair can exempt itself
European regulations, however, state that the airline does not have to pay compensation if it notifies passengers at least two weeks in advance or between two weeks and seven days in advance if it offers them alternative transport that allows them to leave no more than two hours earlier than planned and arrive at their final destination less than four hours late.
If the airline gives less than seven days' notice of cancellation, it does not have to pay compensation if it offers passengers another flight that allows them to depart no more than one hour before the scheduled departure time and arrive at their final destination less than two hours late.
In addition, the airline may reduce compensation by 50% if it offers an alternative transport with a difference in arrival time of no more than two hours for flights of 1,500 km or less; no more than three hours, for intra-Community flights of more than 1,500 km and for other flights of between 1,500 and 3,500 km; and no more than four hours for all other flights.
Refund of the ticket and other expenses
In any case, the European regulation stipulates that passengers must be offered reimbursement of the full cost of the ticket within seven days or be flown to the final destination as quickly as possible or on another date that suits the passenger.
In addition, if the flight is cancelled at a time close to departure, the airline must offer passengers "sufficient food and refreshments" free of charge, depending on the time they have to wait, hotel accommodation if they have to stay overnight or are forced into an additional stay, and transport between the airport and the place of accommodation.
On the other hand, Facua points out that users can also claim any other type of damages as a consequence of the cancellation, such as hotels, organized trips, connecting flights and even moral damages for having lost their vacation or part of it.
